Legislative Procedure for Traffic Calming Procedures under the Road Traffic Act 1994

 

Under the  Road Traffic Act 1994 (As Amended) A road authority may, in the interest of the safety and convenience of road users, provide such traffic calming measures as they consider desirable in respect of public roads in their charge.

 

Notice is hereby given pursuant to Section 38 of the Road Traffic Act 1994 (As Amended) of the following scheme:

 

Loreto School to Cavan Town Active Travel Scheme – Section 2 - Proposed footpaths, cycle lanes and Traffic Calming measures on the R212 between the Cavan Institute and the HSE Sullivan Centre.

The objectives of the project are to:

  • Provide footpath links & segregated cycles lanes between the Cavan Institute and the Cavan Town core along the R212.
  • Increase the number of people arriving at Cavan Institute & St. Patrick’s College by active travel modes and thereby promote better physical health and wellbeing.
  • Enhance safety for children cycling, walking and scooting to school/college.
  • Provide an accessible environment in this area of Cavan Town.
  • Create a pleasant, playful and more welcoming public realm in this area of Cavan Town.
  • Be delivered in a timely and efficient manner.

The proposed scheme will consist of:

  • Upgrading the existing footpaths including junction tightening where required to improve pedestrian safety.
  • Provision of new segregated cycle lanes.
  • Provision of new pedestrian crossings.
  • Traffic Calming Measures i.e. Road Narrowing
  • Upgrade of existing storm drainage along the extent of the scheme.

This scheme will be progressed under Section 38 of the Road Traffic Act, 1994. This section of the Act contains the legislation under which new traffic calming and cycling infrastructure is developed. Typical works carried out under s38 powers include road narrowing, speed cushions, footpath build outs, cycle tracks, bus corridors etc. Delivering these works under s38 powers does not require planning permission.

 

Drawings and particulars of the proposed development will be available for inspection or purchase at a fee not exceeding the reasonable cost of making a copy, during normal office hours 9.00am to 1pm and 2pm to 5pm, Monday to Friday (excluding public holidays), at:

a. Cavan County Council, Customer Service, The Johnston Library, Farnham Street, Cavan, Co. Cavan

b. Cavan County Council, Cavan-Belturbet Municipal District Area, The Court House, Ballyconnell, Co. Cavan

c. www.consult.cavancoco.ie

during the period from Wednesday 1st May 2024 to Wednesday 29th May 2024, both dates inclusive.

Submissions or observations with respect to the proposed development, may be made as follows:

  1. in writing to the road authority as follows: Active Travel Section, Roads and Infrastructure Department, Cavan County Council, Farnham St. Cavan H12 R6V2

  3. via the submissions facility on the  www.consult.cavancoco.ie , on or before 4 p.m. on Wednesday 29th May 2024.
